The National Stem Cell Foundation of Australia Ltd (NSCFA) is subject to the laws governing privacy in Australia, including the Privacy Act 1988 (Cth) and the Information Privacy Act 2000 (Victoria). NSCFA is committed to protecting your privacy.

Any personal information received from visitors to the NSCFA website will be treated as confidential. Your personal contact details will be held and used strictly in accordance with the aforementioned privacy legislation.

Of the information we learn about you from your visit to NSCFA we store only the following: the domain name from which you access the internet, the date and time you access our site, the internet address of the website from which you direct-linked to our site, information regarding the pages within our network which you visit and what you click on. This information is used to measure the number of visitors to the various sections of our site and to help us make our site more useful to visitors. Unless it is specifically stated otherwise, no additional information will be collected about you. This information will only be used for internal NSCFA purposes and not passed on to any third party without your permission.

When inquiries are emailed to us, we store the question and the email address information so that we can respond electronically.

Email addresses and other contact information that are provided to the NSCFA by persons requesting more information will be held on the NSCFA contact list only. The contact list will not be provided to another third party without the knowledge and prior consent of the user.

The NSCFA does not collect cardholder account information from donators using the electronic payment mechanism on this site.  Instead, the NSCFA uses a secure payment gateway embedded within the site supplied by SecurePay, an online payment gateway which is part of Australia Post. SecurePay encrypts all transaction details before sending them across the internet, so the details of the message cannot be seen by anyone except SecurePay's Payment Server.  SecurePay uses a 128-bit digital server certificate provided by VeriSign™. This level of encryption is currently considered realistically unbreakable.

The National Stem Cell Foundation of Australia (ABN: 84 152 713 098) (“NSCFA" or “we”) website (“our website” or “the website”) allows you to donate funds to us. These terms and conditions govern your use of our website.

From time to time we may need to amend these Terms of use and you should review them regularly. Each time you use the website you are deemed to have accepted such changes.

Any donations made through our website using a credit card are final. If you become aware that your credit card has been lost, stolen or is being used fraudulently, it is your responsibility to report the issue to your financial institution.

The materials on our website are provided 'as is' without warranties of any kind either express or implied. To the fullest extent permitted by law, the NSCFA disclaims all warranties, expressed or implied and any prior statements, claims or representations are hereby revoked. The NSCFA does not warrant or make any representations whatsoever regarding the use, accuracy, validity, or reliability of, or the results from the use of, or otherwise respecting, the materials on this site or any sites linked to this site.

Limitation of Liability

Under no circumstances, including, but not limited to, negligence, shall the NSCFA be liable for any direct, indirect, incidental or consequential damages howsoever caused, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if the NSCFA or an NSCFA authorized representative has been advised of the possibility of such damages. If your use of materials from this site results in the need for servicing, repair or correction of equipment or data, you do so at your own cost. You further agree to indemnify and hold harmless the NSCFA to the fullest extent permitted by law.

The liability of the NSCFA for a breach of this Agreement, statutory cause of action, common law or tort (including negligence) in any way is limited as follows: 

  1. we will not be liable for indirect or consequential loss or damage, notwithstanding anything else in this Agreement; and
  2. otherwise in respect of all other claims or liability to you for all other proven loss and damage is limited, for an aggregate of all claims, to the amounts donated by you through our website to the NSCFA.

Our liability for a breach of a condition or warranty implied by law that cannot be excluded, is limited to the extent possible, at our option, to:

  1. the supply of the goods or services again;
  2. the repair of the goods; or
  3. the payment of the cost of having the goods or services supplied again or repaired.


You warrant that the donations that you are making to the NSCFA are donations that you have the authority to make using either your own credit card or are using another credit card the use of which has been expressly granted to you for this purpose.

You warrant to the NSCFA that you are making the donation in your own right or with full authority and hereby indemnify and agree to keep indemnified NSCFA from all or any claims made by any persons claiming such transactions to be unauthorized. You further agree to repay or pay on demand any amounts found to be unauthorized and will indemnify the NSCFA against all losses of whatsoever kind in respect the disputed transaction including (but not limited to) the amount of the original donation, any fines, penalties, legal fees and any other costs or charges of whatsoever kind.

The NSCFA own the intellectual property, including copyright, in all content of this website. Except as necessary for using this website on your browser, or as permitted under the Copyright Act 1968 (Cth) or other applicable laws, no material on this website may be reproduced, adapted, uploaded to a third party, linked to, framed, performed in public, distributed or transmitted in any form by any process without the specific written consent of the NSCFA.
